Acceptance
By requesting or confirming a booking through WhatsApp, phone, SMS or email, paying an invoice or using an SMGLR report, you accept these Terms & Conditions. If you book for another person, you confirm you are authorised to do so and that the report is for buyer-side decision support.
Service scope
The inspection may include available visual and functional checks of mechanical condition, exterior condition, interior condition, accessible underbody areas, tyres, brakes, suspension, basic electrical operation, visible structural/body indicators, diagnostic scan data where available, supporting photos, any agreed video recording, and a road test where safe, legal and permitted.
Inspection process
The inspection documents the vehicle as presented at the agreed time and location, including visible defects, warning signs, operating concerns and buyer-relevant risks. Dirt, wet weather, poor lighting, recent cleaning, seller restrictions or limited access may affect what can reasonably be confirmed.
Customer obligations
You must provide accurate vehicle details, the listing link where possible, seller contact details if you want us to arrange access, and any specific concerns you want checked. You must also ensure the vehicle is available and that reasonable inspection access has been arranged.
Mobile limits
We do not remove undertrays, splash shields, trim panels, covers or components during a standard mobile inspection. We do not jack, lift or crawl under the vehicle unless the inspector decides there is a safe, suitable and agreed setup.
Access limitations
Factory covers, low ride height, poor lighting, wet weather, fresh cleaning, sealed components, locked areas, seller restrictions or unsafe locations may limit what can be inspected. A torch or inspection mirror can improve visibility, but cannot see through covers, metal, sealed parts or blocked areas.
Not guaranteed
No used car inspection can guarantee a perfect vehicle or promise that future faults will not occur. Assessments, risk ratings and recommendations are professional opinions based on available evidence at the inspection time, not guarantees of condition, value, roadworthiness, legality, finance suitability, previous repair history, structural integrity or future reliability.
Not included
Unless separately arranged in writing, we do not verify engine compression or leak-down, internal gearbox/transmission mechanics, timing belt/chain life, water-pump or cooling-fan internals, oil-pump condition, catalytic-converter internals, gas/emissions compliance, ABS hydraulic internals, brake lining material hidden behind sealed areas, brake drums, wheel cylinders, software history or remaining component life.
Specific exclusions
We do not diagnose the root cause of oil leaks, water leaks, fuel-consumption issues, sludge buildup or other internal faults unless the cause is reasonably apparent during the non-invasive inspection. Basic electrical and diagnostic checks do not guarantee control modules, infotainment, navigation, aftermarket accessories or owner modifications.
Hidden faults
Intermittent faults, hidden internal damage, recently cleared warning lights, concealed accident repairs, fresh leaks, weak components, prior overheating, flood damage, odometer concerns or faults that do not present during inspection may not be detectable.
PPSR and history checks
Where PPSR, a vehicle history report or similar third-party information is included, it is obtained or supplied using the vehicle identifier supplied or confirmed for the inspection. Third-party databases may be incomplete, delayed, inaccurate or dependent on correct VIN/registration information.
Buyer responsibility
The buyer must match the VIN, confirm ownership/seller identity, check registration status, confirm finance payout or clear title where relevant and complete any legal, insurance or transfer checks before paying a deposit or transferring money. Any further workshop inspection, specialist diagnosis, roadworthy inspection or professional advice remains the buyer's responsibility before finalising the purchase.
Report and media
The report reflects the vehicle as presented at the inspection time and location only. Photos, and any video supplied or purchased, are provided for transparency and supporting evidence, but do not capture every surface, component, noise, smell, operating condition or limitation. You should review the report carefully and ask SMGLR for clarification if anything is unclear.
Guidance and reliance
Repair-cost guidance, negotiation comments and next-step recommendations are practical guidance only. They are not binding quotes, financial advice, legal advice or a guarantee that a seller will agree to any price. The final decision to buy, negotiate, walk away, insure, register, repair or operate the vehicle remains with the buyer.
After inspection
SMGLR is not responsible for damage, faults, repairs, use, storage, transport, tampering, seller conduct or condition changes that occur after the inspection. The final visual check at payment, pickup or handover is the buyer's responsibility, because new issues may appear before collection.
Full Buyer Support
Full Buyer Support covers one active vehicle search for the original customer for up to 30 days. The $749 package includes two Essential inspections valued at $498. SMGLR will help search, review and shortlist suitable vehicles based on your budget, requirements and market availability, but does not guarantee that a suitable vehicle will be available, remain unsold, pass inspection or be purchased.
Any included inspection is conducted only after you approve the vehicle and the seller or dealer agrees to reasonable inspection access, including access to the vehicle at an agreed location and time, permission for inspection photos and any agreed video recording, diagnostic access where possible and a road test where safe, legal and permitted. A change of buyer, budget, vehicle category or search objective may be treated as a new search.
Bookings and payment
Booking times depend on SMGLR availability, seller or dealer access, location, daylight, weather and safety conditions. SMGLR provides mobile inspections across Melbourne, subject to scheduling; some suburbs may be offered weekend appointments where weekday routing is not practical. Payment is required before the inspection unless SMGLR agrees otherwise in writing. After-hours and weekend inspections may be available by appointment, subject to scheduling and vehicle location.
Rescheduling and cancellations
Appointments are reserved specifically for each customer. By confirming a booking, you accept these cancellation and rescheduling terms.
24 hours' notice. Please give at least 24 hours' notice to cancel or reschedule an inspection. Where at least 24 hours' notice is given, no cancellation or rescheduling fee will normally apply.
Late cancellation or rescheduling. Where less than 24 hours' notice is given, SMGLR may charge a cancellation or rescheduling fee of up to 50% of the booked inspection price. Any fee is limited to the reasonable loss and costs associated with the cancelled appointment, including time reserved exclusively for the booking, lost opportunity to accept another inspection and, where applicable, travel or other costs already incurred. Where SMGLR is reasonably able to fill the cancelled appointment with another customer, the fee may be reduced or waived.
Where an inspection cannot proceed due to customer, buyer or vehicle arrangements. You are responsible for ensuring, before the appointment, that the seller, dealership or vehicle custodian has agreed to the inspection and that the vehicle, keys, correct location and reasonable access will be available at the confirmed time. If an inspection cannot proceed because of circumstances relating to arrangements made by or on behalf of you — including where the vehicle is unavailable, sold or removed; the seller, dealership or custodian refuses or cannot provide access; keys are unavailable; permission to inspect has not been obtained; an incorrect or incomplete address was supplied; the vehicle cannot reasonably be located; or other necessary arrangements have not been made — the appointment may be treated as a late cancellation where adequate notice was not provided, and SMGLR may charge up to 50% of the booked inspection price, subject to the reasonable loss and costs actually or reasonably incurred.
Inspector already travelling or arrived. If SMGLR has already commenced travel to, or arrived at, the inspection location before being advised that the inspection cannot proceed, reasonable travel and appointment-related costs may also be taken into account when determining the fee, subject to the maximum above.
Repeated rescheduling. Customers who repeatedly cancel or reschedule may be required to make a deposit or full prepayment before another appointment is confirmed.
Cancellation by SMGLR. No cancellation or rescheduling fee applies where the appointment cannot proceed because of SMGLR. Any amount paid for a service SMGLR does not provide will be dealt with in accordance with applicable consumer law.
Full Buyer Support. If you cancel Full Buyer Support after support has started, SMGLR may deduct a support fee for work already performed, time reserved, search support, communications, shortlisting and booking preparation. The support fee is capped at $100 if cancelled during days 1-7, $200 during days 8-14, $300 during days 15-21 and $400 during days 22-30. If an included Essential inspection has already been completed, the normal inspection value of $249 per completed Essential inspection will also be deducted from any refund.
Nothing in this policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Where you are legally entitled to cancel the service or receive a remedy under the Australian Consumer Law, this policy will not override those rights.
Report delivery
For completed inspections, SMGLR will deliver the digital inspection report within 1 hour after the on-site inspection is completed. The delivery period begins when the physical inspection and any permitted road test finish, not at the scheduled appointment time. Direct discussion of the findings may occur with or after delivery.
Refunds and failed access
If a seller cancels, the vehicle becomes unavailable or access is refused through no fault of yours, we will work with you to reschedule where practical. Where a fee applies because an inspection could not proceed, it is determined under the rescheduling and cancellations terms above.
Refund eligibility depends on timing, work already performed, travel already completed, services provided, inspection credits used, reasonable costs incurred, the reason for cancellation and your rights under the Australian Consumer Law.
Liability
To the maximum extent permitted by law, SMGLR Auto Checks is not liable for loss, repair cost, purchase cost, price difference, missed opportunity, consequential loss or other damage arising from issues that were not reasonably detectable during a non-invasive mobile inspection, from information that was inaccurate, hidden or withheld by the seller, or from changes to the vehicle after inspection.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, remedy or right under the Australian Consumer Law that cannot lawfully be excluded. SMGLR remains responsible for providing services with due care and skill and for any remedies required by law. Depending on the circumstances, those remedies may include having the service provided again, a refund or compensation for reasonably foreseeable loss or damage caused by a failure to meet an applicable consumer guarantee. No statement in these terms is intended to limit a remedy where the law does not permit that limitation.
